Here at Mini Mountain Puppies, we are dedicated to the best practices in breeding. Your puppy will come from parent dogs that have been fully health tested, well cared for, and paired for the best breeding results. Your puppy will be raised in a loving home, fed nutritious food, well-socialized, and exposed to many sights, sounds, positions, and enrichment experiences. Your puppy will undergo Early Neurological Stimulation from the ages of 3-16 days. We will introduce your puppy to crate training and grass-turf potty training for ease of transition in your new home. Your puppy will come to you with a medical record, first round of vaccines, and deworming. Upon reserving your puppy (paying deposit amount), we make every effort to keep you up to date on information regarding your puppy’s health, gender, size, temperament, coloring, and age.
Puppy Contract:
1. Deposits and Payment: A $500.00 non-refundable deposit is required to hold your puppy. Full payment (the entire purchase price minus the deposit amount) must be received before the puppy will be released to the new owner.
2. Health Guarantee:
A.) Breeder/seller offers a two-year genetic health guarantee. This covers life-threatening and/or life-shortening genetic defects only. Many factors come into play regarding the health of a dog and the length of its life. Since the Breeder/seller has no control over the environment, nutrition, or lifestyle of the puppy once he/she leaves our kennel, you the Buyer are responsible for all health concerns of your puppy. YOU are your dog’s advocate, YOU are responsible to protect it from injury and disease, YOU are responsible to provide proper nutrition, medication, and care.
B.) This health guarantee does not cover Parvo, accidental death, parasites, vet bills, life-threatening injuries, neglect or abuse.
C.) This health guarantee does not cover fixable defects that do not shorten or end the dog’s life, such as but not limited to: under-bite, cherry-eye, umbilical hernia, or undescended testicle.
D.) This health guarantee does not cover any problem that is known to the Buyer before the purchase of the puppy.
E.) In the event that a life-threatening or life-shortening genetic defect is discovered in your Mini Mountain Puppy within 2 years of the puppy’s birth-date, the purchase price of the puppy will be fully refunded by the Breeder/Seller and/or will be replaced with another puppy of the same gender and similar coloring. This may take some time, and is at the discretion of the Breeder/seller as to when the replacement puppy will be available to be given. This replacement/refund will not cover the cost of transportation, vet costs, or any additional costs.
F.) In the event that a life-threatening or life-shortening genetic defect is found in your dog, the genetic defect must be proven by a veterinarian, with a second opinion by a veterinarian of Breeder’s choice at the expense of the Buyer.
G.) Unknown causes of death will not be guaranteed even if veterinarian suspects genetic causes. The cause must be proven.
H.) Health guarantee does not cover vaccine injuries or adverse effects to any medications including flea/tick medications. (Many flea/tick preventative medications have been known to cause seizures or other physical reactions. Be informed and talk to your veterinarian about possible side-effects of such medications before using them. Over-medication is very dangerous for dogs, regardless of what type. You are your dog’s advocate, so please be informed, even if your suggestions are coming from your veterinarian.)
I.) Health guarantee does not cover temperament issues, as this can be caused by influences outside of the Breeder/seller’s control, such as but not limited to: lack of training, lack of discipline, and lack of socialization.
J.) Breeder will be held harmless for any punitive damages caused by the dog after he/she has been transferred to the Buyer. These include: aggression, loss, or health issues pertaining to the dog.
Note: Cavalier Spaniel are prone to Intervertebral Disc and Degenerative Myelopathy (both conditions of the back, extremely common in any dog breed with shorter legs and a longer back), as well as heart weaknesses. These may show up in a Miniature Bernese Mountain Dog. Buyer agrees not to over-feed or over-exercise the dog, especially during growth periods. K.) Parasites: Breeder/seller takes preventative measures against parasites, but does not cover parasites in the Health Guarantee. Parasites are common for puppies and dogs to experience. Upon taking possession of your puppy, it becomes your responsibility to treat your puppy as directed by your veterinarian, and at your own expense.
3. Breeder/Seller offers an Extended Health Guarantee: Here at Mini Mountain Puppies, we are passionate about every puppy living a happy, healthy life. Nutrition is a vital factor in the health and quality of life of your Mini Bernese. Breeder/Seller offers an option to extend the Health Guarantee from two (2) to five (5) years. The Extension is ONLY available to the Buyer that keeps their puppy on pawTree holistic food during the entirety of the health guarantee period. The Buyer must keep a consistent monthly to quarterly EZship with pawTree for two (2) years without cancellation. EZship (or PawClub membership as it is also called), can always be adjusted and moved as needed for your dog, but cannot be cancelled without forfeiting the benefit of the Extended Health Guarantee. (Seller is notified by pawTree when an EZship membership is cancelled.) Buyer agrees to notify Seller before cancellation of their final EZship.
4. We do not cover Veterinary costs or bills once the puppy has left our kennel. Upon possession, all further costs become the responsibility of the Buyer. This includes the cost of spaying/neutering. (We recommend waiting until 1 year of age to spay/neuter, as studies have shown it to reduce the risk of cancer and hip dysplasia.)
5. Return/Refund window: If your Veterinarian determines that your puppy came to you in an unhealthy condition, at the Breeder/Seller’s discretion, the puppy will be returned and replaced with another available puppy of similar coloring and gender OR the puppy will be returned and the Buyer will be refunded the full original purchase price of the puppy. Buyer must notify the Breeder/seller within 7 calendar days of receiving the puppy in order for the return/refund to be honored.
6. Breeder/Seller reserves the right to refuse the purchase of a puppy for any reason.
Buyer Agreements:
7. Buyer is able to provide proper care, including medical and nutritional.
(Do not allow extreme jumping, long distance running, or biking with your puppy before they are 2 years of age, as this can cause health problems as they grow. Do provide fresh water for your dog at all times.)
8. Puppy Value: For the purpose of the Health Guarantee, the Puppy value is limited to the Purchase Price of the puppy, and does not include additional expenses such as taxes, vet costs, transportation costs, or any other expenses incurred by the Buyer.
9. Mini Mountain Puppies sells dogs as pets ONLY. Breeding is strictly prohibited, and will be considered a direct breach of this contract.
10. Photo Rights: We truly love and appreciate pictures and testimonials of your puppy! If you send Breeder/seller photos, or if you verbally consent to photos being taken at the pickup of your puppy, Buyer hereby authorizes copyrights to the Breeder. Photos/videos may be used on our website and/or social media platforms.
11. No Financial Returns: Outside of the terms of the Genetic Health Guarantee, Breeder/Seller will not issue any monetary refund upon the return of a puppy for any reason including, but not limited to: landlord/tenant restrictions, allergies, marital conflict, financial hardship, or puppy adjustment issues. Buyer may always return a puppy, but it will be strictly on a surrender basis only, with no monetary refund of any kind. Upon such surrender, Breeder will professionally find a new and appropriate home for the dog. Buyer will be responsible for the expense of transporting the dog back to Mini Mountain Puppies kennel.
12. Puppy Rehoming: Buyer agrees to contact Mini Mountain Puppies first, in the event that Buyer can no longer keep the dog. This stands regardless of the age of the dog. We retain the first right of refusal, meaning that you promise to contact us first before rehoming the dog. We will always lovingly take back any Mini Mountain dog with no criticism or judgement as to the reason, for we understand that unforeseen situations and difficulties come up. Our goal is to keep all Mini Mountain dogs out of shelters or anywhere else that they are not wanted. We understand and appreciate that this would be a difficult decision and we are here to make it as easy and seamless as possible.
13. Cancelling Puppy Purchase: In the case that the Buyer wishes to cancel the purchase of a puppy, this may only be done before the full purchase price has been paid. Buyer also understands that the $500.00 deposit is non-refundable for any reason.
14. Puppy Deliver and Puppy Release Date:
A.) Typically, Mini Mountain Puppies will release the puppy at the age of 8 weeks old to the Buyer who has purchased him/her. However, the health and best interest of the puppy is always considered first. Breeder/seller retains the right to adjust the release date of the puppy for any reason. Reasons may include but are not limited to: health and comfort of the puppy and insight of the veterinarian, weather, temperatures, logistics, kennel schedules, and mechanical issues. Breeder is not liable, directly or indirectly, for any delays, including but not limited to delays that may cause inconvenience or even financial loss to the Buyer, nor will any delay be valid cause for the cancellation of the puppy purchase by the Buyer.
B.) Buyer understands and agrees that no refund will be issued by the Breeder/seller due to any airline/airport delays or cancellations of the puppy’s flight. Buyer is solely responsible for all expenses regarding the travel of the puppy.
15. Agreement to Mandatory Individual Arbitration: Instead of suing in court, Buyer and Seller agree that any dispute, controversy or claim arising out of, or relating to, this agreement shall be resolved only by final and binding Arbitration on an individual basis. Buyer agrees that, by entering into this agreement, Buyer and Seller are each waiving the right to a trial by jury and the right to participate in any class or representative action. The Buyer and Seller further agree as follows:
A.) Buyer and Seller each are responsible for their respective costs relating to the counsel, experts, and witnesses.
B.) If Buyer or Seller fails to comply with this arbitration provision, said breaching party shall be liable for the cost of attorney’s fees incurred by the other party in enforcing compliance with the arbitration agreement.
C.) All claims or arbitrations regarding this contract will be held under the government of the State of Indiana.
16. Severability: If any provision or provisions of this Agreement is held to be illegal, invalid or unenforceable under applicable law by a court of competent jurisdiction, the validity, legality and enforceability of the remaining provisions shall continue in full force and effect and shall not in any way be affected or impaired thereby.
16. Entire Agreement: This Agreement represents the entire agreement between the Parties and no other terms or conditions shall be applicable to this sale. A deposit put on a puppy conveys that all parties, seller, and buyer, agree to the above terms and conditions. Any changes to this contract must be given in writing and signed by both Buyer and Breeder/Seller.
